A Living Trust - What Is it Exactly?

A living trust is a legal document that contains your instructions for what you want to happen to your assets when you die. A living trust avoids expensive probate at death, controls all of your assets and can prevent the court from controlling your assets if you become incapacitated.

Benefits of Having a Trust
A trust helps you avoid probate (including multiple probates if you own property in other states), save in taxes, provides maximum privacy, is relatively inexpensive, is easy to set up and maintain, and provides quicker distribution of assets to your loved ones.

Not having a trust will expose your loved ones to the very expensive probate process which can take up to 18 months or longer; your assets will not be kept confidential, attorney fees will be paid from your estate along with court costs, and sadly assets are distributed according to state law, not your wishes.
